Cohabitation and Civil Partnership
The Family Law (Scotland) Act 2006 came into force on 4th May 2006. Opposite and same sex couples who cohabit now have certain rights if their relationship comes to an end or if one of them dies.
Since December 2005 same sex couples can register as civil partners. Civil partners have very similar rights to a married couple.
We can advise you if your relationship or civil partnership has come to an end.
We can advice you of those rights particularly as any claim made by a cohabitee in the event of their relationship ending must be raised in the Sheriff Court from to the expiry of one year from the date of the cohabitation ending.
