Residence & Contact
A mother of a child automatically has Parental Rights and Responsibilities in respect of her child or children. Every married parent also has these rights and responsibilities.
On separation or Divorce we can assist you in reaching an agreement with your former spouse as to where the children are to reside or how contact is to operate. We can refer you to the Family Mediation Service and if necessary advise on the merits of a court action. It is always best if parents can decide and agree these arrangements rather than have the Court decide.
Where a child is born after 4th May 2006, unmarried fathers have full Parental Rights and Responsibilities for their children provided that they are registered as the father on the child’s Birth Certificate.
Unmarried father’s who do not have Parental Rights and Responsibilities can enter into a Parental Rights and Responsibilities Agreement with the mother of the child or if necessary, can ask the Court to grant his Parental Rights and Responsibilities, contact or residence.
